Who Are You Kidding, Orange and Lemons?

Ridiculous! is all I have to say about the whole Orange-and-Lemons-futile-whitewash-attempts fiasco. In an article by Jojo Panaligan for the Manila Bulletin dated October 16 2005, the band is “saddened” because all the hoopla about them copying a foreign song is “unfair”. But they do admit that the “guitar intro part” was “perhaps” a basis for inspiration for the Pinoy Big Brother theme song but added that most New Wave songs began with a guitar melody. Huh? Anong ibig sabihin non? That all guitar intros back then sounded alike? Does that lame belief give them the license to copy another song’s intro? They go on saying that “Chandeliers” was the “peg” for “Pinoy Ako” but wasn’t derived from that or any other song. What?? Can you spell R-E-D-U-N-D-A-N-T??

What’s even funnier is that in another article of the same date by Kate Villagomez published in Manila Bulletin, the boneheads admit that “We did make it Carish”. “Chandeliers” is a song by a British band The Care, composed of Paul Simpson and Ian Broudie. So, silly me, “Pinoy Ako” was NOT derived from “Chandeliers” but the latter served as a “peg” and they made it “Carish”. Yet at the band’s discussion group, they claim that “they were just waiting to be noticed by Simpson and his camp”. Asked if they acknowledged the Care (for using “Chandeliers” for “Pinoy Ako”), vocalist Clem Castro argues “E bakit kami magpapaalam? Magpasalamat pa nga ang The Care at pinasikat namin ang kanta nila.” Kapal!! Let’s try that again:

HUH??

As of the above article’s publishing, Giselle Roque (Villagomez’s informant) had informed Paul Simpson (who is a friend of hers) and his recording label about Orange and Lemons’ blatant copyright violation.

As if things couldn’t get any more confusing, Jocelyn Valle of the Philippine Daily Inquirer writes an article “Orange you glad they’re no lemons?” (October 19 2005) where the same Clem Castro quips, “We have no malicious intent. In fact, we’re not even aware that such songs (“Chandeliers”) already exist.” Is Clem suffering from short term memory loss or is he just plain dumb? What is he up to??

Oranged and Lemons makes me sick in the stomach and utterly ashamed to be a Filipino. These incoherent crackheads give us a bad name and should be STOPPED at all costs! Nakakahiya sila!

    Just some rebuttals for fans-in-denial all over the web: This thing is being discussed and OnL is being taken to task not because of “crab mentality” or “inggit.” The fact remains that the song (whose spirit and lyrics were provided by a lyricist & not OnL) is about being Pinoy and about proudly proclaiming what we are capable of. Hence, a lot of us patriots cannot take this thing sitting down…We know we are more than great copycats and innovators/samplers! We have a lot of talent and we want this to shine through! We want to be recognized for who we really are and what we can do! We don’t want to sell ourselves short by clamming up for the sake of so-called “peace” and let ourselves be represented by a song – a band – an image – that grossly misrepresents who we proudly are and what we can really do! Clamming up and “settling” for less than what we deserve has been our sin for so long…We don’t want Pinoy music, which makes up a large part of our identity, and its industry to be a macrocosm of our political landscape and social suffering now do we?

    We have a lot of superb, young bands with excellent material just waiting for the proper break. It’s just a shame that the influential PBB media machinery was used on a project that sells us short. (Note that I said “project” and not “band”. Pinoys are forgiving to a fault and OnL will surely get a 2nd, 3rd, 4th chance.) Whoever ABS gets to sing (not even compose) the PBB theme song will influence Filipinos far & wide, they’ll be a household name. Recall just how far OnL has gone because of this project…Now imagine, sitting in their place now, another of your favorite OPM bands who are still not getting the recognition they deserve. Now you see what I mean? There are a lot of them out there… I’m not saying OnL is not deserving. It’s simply that the resources could have gone further and done more good had it been handled better. And we are voicing this out so that PEOPLE LEARN THEIR LESSONS & NOT COMMIT THE SAME MISTAKES.

    On the more technical side: It is not sampling. And even if The Care were merely sampled, all the more it requires artist credits. And it cannot be just “similar”, “inspired by” or “pegged on” Chandeliers either, because of the uncanny similarities in chords, notes, and arrangements of guitars/banduria, drums and bass lines. Neither can it pass the “7 chord progression rule” (which itself is debatable). The similarities overwhelm that rule. It’s not just the intro, it’s not just the verses. The chorus, contrary to Clem’s claims, seems the same. And it’s not hard at all to sing Pinoy Ako’s lyrics to Chandeliers instrumentation (contrary again to Clem’s claims). The main melodies are identical. And as I found out, even Pinoy Ako’s bridge has the same chords/melody as Chandelier’s coda. And if you still don’t believe me, listen to this mash-up I made, a response to OnL’s challenge to match the two songs note for note – an unedited Chandeliers panned mostly on the left channel, running side by side with Pinoy Ako on the right channel spliced to match respective stanza-chorus-coda/bridge counterparts part-per-part:

    ONL has not only lied to its teeth but as far as I’m concerned, they are worst than rapists! They have not only raped Care out of their royalties but there they are bragging to the whole world that they are bonafide and certified thieves. Translations sa mga hindi makaintindi, ni rape na, ninakawan pa!

    The Resemblance of Pinoy Ako and Chandeliers -

    A few days ago, i listened to Chandeliers and tried singing the
    lyrics of Pinoy Ako in it. I found it hard na pagsabayin. Both songs
    were submitted to authorities in the music scene and were subjected
    for analysis and have concluded — Pinoy Ako and Chandeliers are two
    different songs. The same with the stand of the band and the labels
    concerned. There are elements na malapit sa isa’t isa and the mood
    of the song are on the same line.. but the songs were still
    considered different from each other.

    On a personal note.. I enjoy both songs.

    Product of pressure? -

    Clem once used this term to describe the circumstances and the time
    frame with which ONL was required to finish the song for PBB. But
    the mood in the studio when we were recording the song was
    completely different. We were working well and enjoying the process
    much. I remember all of us agreeing to “ok lads.. lets jam this one
    and lets hear wat wud come out naturally from us”. The sound that
    you hear therefore is a mish-mash of the sounds of artists whom we
    have listened to for so long now — not just Care, but would include
    The Beatles (harmonies), The Smiths (guitar fills and licks), APO
    and Rey Valera (the baritone and falceto (tama ba sfelling nito?
    wahehe) approach on the vocals).

    Was there a denial with your knowledge of Care and their songs? -

    None whatsoever. We have always been open with regards to our
    influences and the musical genre that we “supposedly” belong to –
    Indie pop-rock bordering on new wave–. A publication quoted Clem
    saying “In fact, we were not even aware that such songs exist.”.. It
    was Clem referring to songs like “Happy Hour” of the Housemartins
    (in comparison to A beginning of something wonderful) and a certain
    N’Sync song (hehe) (in comparison to The Nerve).

    Arrogance? -

    ONL was gravely misquoted.. most especially Clem. I feel for him. He
    was never irked or irritated when asked about the issue (in casual
    conversations, text messages or formal interviews). He was dealing
    with inquiries well.. and so were the three of us in ONL. We have
    never bragged about anything.. simply proud of the things we have
    accomplished as a band and how we managed to stay the same.

    We were quoted saying..”eh bakit kami magpapaalam? Pasalamat pa nga
    ang The Care dahil pinasikat namin ang kanta nila”..

    ..actually what i said was “We wer quite happy to share din with
    you, that a number of listers in the ONL egroup dug
    out “chandeliers” and the music of CARE after reading about this
    issue.. guess what?.. They are now loving the music of Paul Simpson
    and the rest of the crew. =) kakatuwa din un. Imagine high school
    and college students of today gettin aware and humming the music of
    old that we all learned to love? cool.”.

    There are a couple more quotes or misquotes that was greatly
    misinterpreted but please do understand that I don’t wanna dwell in
    this anymore. Thanks.

    Does ONL ever get tired of explaining this issue? -

    We don’t mind explaining our side. But we’d prefer not to dwell in
    it. It’s been a month or two since we’ve discussed this with friends
    and some people in the scene. ONL has moved on. The song has served
    its purpose for the PBB show. Right now we are more preoccupied with
    new projects. Exciting time for us.

    It is a fact ladies and gentlemen that there are people who have set
    their minds and conclusion regarding the issue. It was never an
    intent on our part to justify ourselves and convince them to change
    their views otherwise. We just share our side. We respect each and
    everyone’s take on the matter.

    Is there anything to learn from all this?

    Of course. Just the same as with anything that happens to anyone. We
    are a young band. Great room for improvement. We are simple
    musicians. We write songs and play them for people to hear. Either
    you like us or hate us or be completely indifferent. What matters to
    us greatly is we are able to get the music across.

    What is there to expect from ONL?

    Please do watch ASAP Mania this Sunday. We’ll be launching a
    repackaged Strike Whilst The Iron Is Hot album. This one will
    include a bonus cd/vcd containing — the music videos of Hanggang
    Kailan and Heaven Knows, Naked versions of Hanggang Kailan and
    Heaven Knows, a new song called Abot Kamay, 2 Versions of Blue Moon
    and Pinoy Ako (label’s decision to include this one ser noel wahehe
    =)..)

    Strike album is still the collection of our 12(13) tracks.. may
    bonus CD lang ‘tong repackage. It so happened that ONL was blessed
    with a number of projects in the past few months that we all decided
    to put it all in one bonus CD. I think it’s neat.

    Stay tuned for the airplay of ABOT KAMAY this weekend or early next
    week in radio stations and the airing of a commercial/music video
    that comes along with the song to be aired starting Nov.6..

    Wait lang peeps. Care lang ang name ng band, hindi “The Care”. Yung Philippine release lang nila yung “The Care” must’ve been a typo dito hehehe pero all their other albums/complilations refer to them as Care. FYI lang.
